Plaintiff Took That Night to Court
In the lawsuit, the woman identified as “Jane Doe” said she was 20 years old at the time of the incident. According to the claim, on the night of 19 October 2024, after events on the Cornell campus, she went to the Chi Phi fraternity house. The plaintiff alleged that two fraternity members forced her to use a substance they said was ketamine, and then sexually assaulted her. According to the complaint, later other men also came to the house and the woman claimed she was sexually assaulted for hours.
After the Assault Allegation, She Contacted the University
Jane Doe said she approached Cornell University's police unit about three weeks after the incident. The university then conducted its own investigation. According to CBS News New York, at least 12 hearings were held as part of the inquiry. Plaintiff's lawyer Thomas Giuffra said that only two of the seven students were expelled from the university, while some others received disciplinary sanctions such as suspension, educational programs, or written assignments.
Prosecutor Did Not File Criminal Charges
The Tompkins County District Attorney said that the police investigation was examined in a comprehensive manner, but concluded that there was insufficient evidence to file criminal charges. He reported that no one has been arrested in connection with the assault allegations.
Statement on the lawsuit from Cornell
Cornell University announced that its Office of Civil Rights and the Office of Student Conduct and Community Standards investigated the allegations within the framework of university policies. The university also noted that the Chi Phi chapter's Xi division has been expelled from campus. Cornell said it could not disclose details of individual disciplinary proceedings involving students due to federal privacy laws.
Cornell Forms Sexual Assault Task Force
The university said it had established a task force to address sexual assault cases on campus following the investigation and had made changes to some practices. Cornell also noted that mechanisms exist for students to report various incidents, including sexual harassment, discrimination, and sexual assault.
Alumnus Seeks Monetary Compensation
In Jane Doe's lawsuit, allegations of breach of contract, negligence, and violation of state laws are directed against Cornell University and other defendants. The plaintiff seeks both compensatory and punitive damages, but the total amount requested is not specified in the complaint. The plaintiff states that he left the university after the incident.
Chi Phi: We Take the Allegations Seriously
Chi Phi's national headquarters stated in a statement to CBS News New York that the sexual assault allegations raise serious concerns. The organization condemned sexual violence and said it could not comment on the details of the incident due to the ongoing lawsuit.
