It was noted that the information contained in tax returns for immigrants preparing citizenship applications in the United States must be carefully reviewed, especially for those benefiting from the three‑year citizenship rule based on marriage. According to Atakan, a person who filed a citizenship application through another lawyer approached them for interview preparation. When the previously submitted documents were reviewed as part of the preparation, a noteworthy detail emerged: the applicant’s tax return listed their marital status as “single,” i.e., “unmarried.”
Documents Showing the Marriage Is Ongoing Carry Weight
Atakan said the matter is particularly important for those who obtain a Green Card through marriage to a U.S. citizen and who apply for citizenship after the three‑year residency period, because the marriage is still ongoing.
Atakan explained that in such citizenship applications, immigration authorities assess whether the marriage is still ongoing, and he emphasized that tax records are among the documents that can be examined as part of the entire file.
Therefore, it was pointed out that a married person listing themselves as “single” on a tax return could create a discrepancy that would require explanation during the citizenship interview.
Error Detected Before Interview
Atakan, who noted that the tax return had already been submitted in the file in question, said he had advised his client to have the return amended, i.e., to carry out a correction. He also said they had prepared how to explain the situation to immigration officials in the event of an interview.
Atakan said that if they were to prepare the file from the beginning, they would first prefer to correct the problem in the tax return, and then to submit the citizenship application.
Interview Preparation Is Not Just About Studying Questions
Atakan, who pointed out that merely studying potential questions is not enough when preparing for an interview in the citizenship process, said that it is also necessary to check whether previously submitted applications, tax records, and other documents are consistent with each other.
Atakan emphasized that those who apply for citizenship under the three-year rule after obtaining a Green Card based on marriage must pay attention to marital status and filing status in their tax returns.
Because the conditions of each immigration and tax file can differ, the impact of a status listed on a tax return on a citizenship application may vary according to an individual's particular circumstances.
