A court ruling was issued regarding Oscar Bergal, who was shot by an ICE agent in New York City. The judge temporarily barred the deportation of the 28‑year‑old Bergal. Under the ruling, federal officials will not transfer Bergal to any facility outside New York’s Southern or Eastern judicial districts or New Jersey without court approval.

The incident occurred on Thursday, October 8, in the Marble Hill neighborhood of New York. Uniformed ICE agents approached Bergal’s vehicle, who was seated in the back seat with his five‑year‑old son. While security‑camera footage showed the car moving, the U.S. Department of Homeland Security (DHS) said one of the agents fired and that Bergal was wounded in the neck. The child did not sustain injuries but witnessed the harrowing moments.

Federal Officials Defended the Operation

DHS said the operation was carried out to detain Bergal. Federal officials alleged that the Dominican Republic citizen Bergal was in the United States without legal status and had ties to the Trinitarios gang. Officials also claimed that Bergal refused to obey orders to exit the vehicle. The New York Police Department (NYPD) stated that Bergal was convicted in 2023 of a major robbery and had previously been detained on charges of assault, burglary, and weapons possession.

They Are Demanding the Release of Their Lawyers

Bergal’s attorneys filed a legal request to remove him from federal custody, arguing that his clients were taken into custody without a valid arrest warrant. Bergal was taken to hospital after being shot; he was then transported to a detention center in New Jersey, and subsequently to the Metropolitan Detention Center in Brooklyn.

The court’s decision does not mean that Bergal has been released. While the deportation process is temporarily halted, the legal proceedings related to the case continue.
