The penalty for assaulting a CBP officer in New York has been set.

In a federal case tied to the shooting of an off‑duty Customs and Border Protection officer in New York, two defendants were sentenced to 12 years 6 months and 15 years in prison. The defendants will face a judge again in November on state charges related to the incident.

In the United States, two defendants were sentenced to prison on federal charges in a case involving the shooting of an off‑duty U.S. Customs and Border Protection officer in Fort Washington Park in Manhattan, New York.

Miguel Francisco Mora Nunez was sentenced to 15 years in prison followed by 3 years of supervised release in the federal case. The individual named Christhian Aybar‑Berroa, who was reported to have been riding a motorcycle during the incident, was sentenced to 12 years and 6 months in prison and 3 years of supervised release.

Both defendants had previously pleaded guilty to the charge of possessing ammunition by individuals who were illegally present in the United States.

He was shot in the chest and arm by a CBP officer.

The incident occurred on the night of July 19, 2025, in Fort Washington Park near the Little Red Lighthouse.

According to officials, the 42‑year‑old off‑duty CBP officer was sitting in the park with a friend when Mora Nunez and Aybar‑Berroa approached on motorcycles.

It was reported that Mora Nunez drew his weapon and fired, striking the CBP officer in the face and right arm. Despite his injuries, the officer returned fire with his own gun and hit Mora Nunez in the leg and groin. The suspects later fled the scene on a motorcycle.

The officer's treatment is ongoing.

The CBP officer who was severely injured in the armed assault underwent numerous surgeries after the incident. The officer requires further operations due to wounds on his face and has lost the range of motion in one of his thumbs.

The officer, who attended the arraignment wearing a face mask, remained silent but submitted a letter to the court. Officials said that his swift intervention during the incident and a NYPD officer who transported him to the hospital played an important role in saving his life.

The state case will continue in November.

In addition to the federal case, there are numerous charges against the two defendants in the state of New York.

The defendants face charges of assault, attempted murder, attempted robbery, robbery, and possession of a weapon. Mora Nunez is also charged with attempted murder.

Both defendants are expected to appear before a judge again in state court this November on these charges.
