Requested Their Lawyers Be Released

Bergal’s attorneys, arguing that their client was taken into custody without a valid arrest warrant, filed a motion with a federal court in Manhattan on Friday. Attorney Howard Solis said Bergal was still in pain while the bullet was in his body. According to the lawyers, Bergal was first taken to a detention center in Newark, then transferred to the Metropolitan Detention Center in Brooklyn.

DHS Endorsed the Intervention, Witness Objected

The U.S. Department of Homeland Security (DHS) alleged that Bergal did not comply with the officers' legal orders and accelerated his vehicle, colliding with two ICE vehicles before proceeding toward other officers. ICE official Marcos Charles said the operation was carried out within the scope of enforcing immigration laws. However, Ruth Hilaria, who works at a butcher shop near the scene, told CBS News New York that she saw the vehicle pull away from ICE officers. The discrepancies between the parties' statements heighten the importance of the investigation.

The Child's Fear Takes Center Stage

DHS stated that it was unaware that a five‑year‑old child was in the vehicle of the officer who opened fire. Witness Hilaria said that after the armed intervention the child cried while calling out to his father. New York Governor Kathy Hochul also reported that the child's mother said her son was frightened after the incident and kept recounting what had happened. Representative Adriano Espaillat said he visited the child in the hospital and that the child's physical condition appeared good.

New York Administration Calls for Investigation

New York City Mayor Zohran Mamdani said he was trying to speak with President Donald Trump and Homeland Security Secretary Markwayne Mullin to secure Bergal's release. Governor Hochul called for a temporary halt to ICE operations in the city. New York Attorney General Letitia James urged that the incident be investigated thoroughly and transparently. Bronx District Attorney Darcel Clark also reported that his office is conducting a comprehensive review based on evidence and the law.

Protests Followed the Incident

Bergal’s shooting heightened reactions to ICE operations in New York. Mayor Mamdani, in a statement Thursday evening, argued that city residents should be protected against ICE officers’ interventions. Five people were detained during protests held Thursday night. A new demonstration was also planned for Friday evening in Lower Manhattan.
