ICE Limit on Immigration Operations in New Jersey
In New Jersey, a federal court upheld the regulation limiting ICE's use of state property in immigration operations.
The U.S. federal court in New Jersey adopted a regulation limiting ICE's use of certain state-owned areas for immigration operations.
Federal Judge Georgette Castner dismissed the lawsuit filed against the order signed in February by New Jersey Governor Mikie Sherrill of the Trump administration on September 4.
Access to State Property Restricted
According to Sherrill's order, federal immigration officers cannot enter state-owned closed public areas without a court-issued search warrant.
The regulation also bars the use of state property as a staging area, processing center, or operational base for ICE operations.
Barrier to Federal Government Funding
The court ruling stated that the federal government cannot compel New Jersey to allocate its own resources to federal immigration programs.
The decision also points to the need to protect states' authority over the use of their own property and resources.
ICE's operations are not banned.
The court's ruling does not halt ICE's activities in New Jersey. The restriction specifically targets the use of certain state-owned areas in immigration operations.
ICE officers can continue their operations within the existing rules governing public spaces. Access to closed state property requires a court order or search warrant.
An appeal process is expected.
It remains unclear whether the federal government will take its decision to a higher court. If the case is appealed, the legal dispute between New Jersey and the Trump administration is expected to continue.
